Automatic Exemption from Penalty (AEP) begins replacing First Time Abate

The IRS will introduce the Automatic Exemption from Penalty (AEP) in summer 2026, replacing First Time Abate. AEP will be applied automatically for eligible taxpayers—those with three years of timely filing and tax payment history—for failure to file, pay, or deposit penalties on eligible returns starting with tax year 2025 and 2026 quarterly returns. Not all penalties or return types are eligible. AEP requires no taxpayer action. Those eligible will receive a notice. First Time Abate becomes unavailable for returns due on or after January 1, 2027.
